1. Acceptance of Terms

By accessing or using MyWishBook (the "Service"), you agree to be bound by these Terms & Conditions. The Service is operated by Mohammedhusen Malek ("we", "our", "us"). If you do not agree, do not use the Service.

2. The Service

MyWishBook is a web and mobile application for creating wishlists, tracking birthdays, anniversaries, holidays and events, and generating AI-powered gift suggestions. We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.

3. Account & Authority

You must be at least 13 years old (or the age of digital consent in your country) to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable Use

You must not:

• Use the Service for any unlawful, fraudulent or harmful purpose.
• Upload malware, attempt to probe, scan or breach security.
• Scrape, copy or redistribute Service data without permission.
• Infringe intellectual property, privacy or other rights of others.
• Send spam or unsolicited communications via the Service.

5. Intellectual Property

All software, design, branding and content of the Service are owned by Mohammedhusen Malek and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of content you upload, but grant us a limited license to host and process it solely to provide the Service.

6. Subscriptions, Payments & Billing

MyWishBook offers a free tier and paid "Pro" subscription plans billed monthly or yearly. Subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the paid period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are also governed by the Paddle Buyer Terms.

8. Suspension & Termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. You may close your account at any time via the account deletion page.

9. Disclaimers & Liability

To the fullest extent permitted by law, we disclaim all implied warranties of merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages. Our aggregate liability shall not exceed the fees you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence where prohibited by law.

10. AI-Generated Content

AI gift suggestions are generated automatically and may be inaccurate or unsuitable. You are responsible for evaluating outputs before acting on them. Do not rely on AI suggestions as professional advice.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the seller's jurisdiction, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction.
